Acknowledgement of Risk

When participating in your safari/tour, you hereby confirm that you understand, acknowledge and agree that:

There are certain risks and dangers inherent in taking part in a safari/tour and that, by the very nature of the travel services and excursions involved in the safari/tour, you will be exposed to an element of personal risk over and above those associated with a conventional holiday, including staying in areas where wild animals roam. Driving conditions may be uncomfortable due to road conditions where bumps and potholes are common., for your safety it is advisable to wear a seat belt when travelling in a vehicle. A safari/tour includes the risk of personal injury and death to yourself and loss of or damage to your property. You must accept full responsibility for these risks and are under a duty to mitigate any risks to yourself as far as is practicable, by taking all reasonable steps to ensure your own safety whilst participating in the safari.

You are adequately fit and physically capable of taking part in the safari/ tour and have no medical or other condition which would in any way affect your participation in the safari/tour. For any pre-existing health conditions, you understand it is your personal responsibility to carry any necessary medications with you.

You are carrying adequate travel insurance to cover medical expenses, evacuation or repatriation in the event of a medical emergency.

You are required to follow all instructions provide to you by Governors’ Camp employees or agents, including local instructions and advice of the guide and host relating to activities where wildlife is involved, as this is crucial to your own safety and security and the safety and security of the other guests. This includes but is not limited to: not walking around camp between the hours of dusk and dawn without the escort of a guard, not getting out of the jeep on a game drive unless your guide has said it is safe to do so, being quiet in the presence of wild animals so as not to startle or frighten them

You are at all times solely responsible for your possessions, including your photography equipment.

It is presumed that by confirming your booking with payment of a deposit that you have read and agreed with the T&C’s as laid out below and acknowledged the risks involved in a safari and your responsibility to mitigate those risks
Terms and Conditions
Photographic Safaris
1. A non-refundable deposit of the amount stated in each photographic safari description is required at the time of booking. A completed reservation form is also required to complete the booking.

2. The balance of the photo safari price is due 60 days prior to the departure date. Should this final payment fail to reach us by the date specified, we reserve the right to treat the booking as cancelled and retain the deposit. If a booking is made 60 days or less prior to the departure date then the full amount is payable at the time of booking.

3. Any cancellation by the client made in the 60 day period prior to the trip will mean that Ann Aveyard Photography retains the total cost of the photo safari unless the clients place is sold on. If this should happen only the deposit will be retained by Ann Aveyard Photography, and the balance refunded to the client.

4. The receipt of a deposit does not imply acceptance of a booking. We will confirm our acceptance of your booking in writing by email, and it is at the time we send out this confirmation that a contract comes into existence between us.

5. Ann Aveyard Photography reserves the right to alter or cancel any photo safari. Should an alteration or cancellation become necessary, we will notify you and you will then have the choice of accepting the change, taking an alternative photo safari (and where this is of a lower price we will refund the difference), or withdrawing from the contract and accepting a refund of all monies paid to Ann Aveyard Photography. For the avoidance of doubt, as Ann Aveyard Photography is not party to any flight bookings you make yourself and has received no payment for the same, we will not refund the costs of your flight in the event of holiday cancellation. You are referred to clause 15 below.

6. Ann Aveyard Photography can accept no responsibility for cancellation of a photo safari due to Force Majeure. Force majeure is unusual and unforeseeable circumstances beyond our control, such as war or the threat of war, riots, terrorist activity, civil strife, industrial disputes, natural or nuclear disaster, fire, flood or adverse weather conditions. In the advent of cancellation due to Force Majeure, please refer to clause 15 below.

7. In the event of the specified tutor being unable to attend due to illness or other circumstances beyond our control, another tour leader will be provided. If this is not possible, then the photo safari will be cancelled and the provisions of clause 5 will come into effect.

8. We reserve the right to change any of the prices, service or other particulars contained in this at any time before we enter into contract with you. If there is any change, we will notify you before we enter into such contract.

9. If you have special dietary or other requests, you should inform us of these prior to departure. We will advise the relevant supplier of your requirements, but we cannot guarantee that such requests will be met, and will have no liability to you if such requests are not met.​

10. Where airport/hotel transfers are included in the cost of the trip, such transfers are only included when participants travel on the flights specified by us. Participants arriving or departing on different flights will be responsible for their own transfer costs and arrangements. Flight booking is the client’s responsibility and Ann Aveyard Photography is not responsible for any expenses, loss or other damage caused to you by the acts or omissions of the carrier. You are referred to clause 16 below.

11. The type of photographic safaris we offer requires flexibility and must allow for alternatives. For this reason the outline itinerary and safari description must be taken as an indication of what may take place on the holiday, and not as a contractual obligation on the part of the company.

12. Ann Aveyard Photography does not accept liability for any loss or additional expense caused by delay or interruption to travel services through weather conditions, civil disturbance, industrial action, strikes, wars, floods or sickness. Such losses or additional expenses are the responsibility of the passenger.

13. Ann Aveyard Photography accepts responsibility for acts and /or omissions of its employees (whilst acting in the course of their employment). The Company does not accept responsibility or liability for death, bodily injury or illness caused to the client or any other person included on the booking form, unless arising from the negligent act and/or omission of the Company’s employees (whilst acting in the course of their employment).

14. The client must communicate any perceived failure in the performance of this contract on the spot to the tour leader thus giving the tour leader the opportunity to achieve a satisfactory solution. Should this not be possible, you should make your complaint known to us in writing within 28 days of the completion of the holiday.

15. It is a term of the contract between us that you will obtain the appropriate travel insurance cover before you set out on the photo safari tour. The insurance must cover the loss, expenses and damages arising from, including but not limited to, the cancellation of the photo tour (whether in whole or in part), personal accident and injury, medical and repatriation costs (for overseas holidays), loss of baggage and personal money and belongings and flight cancellations and delays.

16. All clients must be in possession of a valid passport and all visas, permits and certificates, including medical certificates required for the whole of the journey and the client accepts responsibility for obtaining the same. All information and advice given by us on visas, vaccinations, climate.

17. Clients should understand that we are attempting to view wild animals that are free-roaming in their wild, natural habitat. There is no guarantee of viewing any particular animal. Locations that give the best chance to see a variety of animals are chosen, however; it must be understood that we may see any animal at any time, or no animals at all.

18. Ann Aveyard Photography will not be held liable for any disruptions or inability to fulfil her services due to circumstances beyond her control. These unforeseeable events may include, but are not limited to, extreme weather conditions, park closures, transport incidents, fires, floods, disease outbreak, terrorist incidents, or any similar occurrences.

18. By signing the booking form, you are agreeing to accept all the above conditions. The person who signs the booking form does so on behalf of all the individuals included on it, so that all are bound by the booking conditions.

Responsibility
Travel carries some measure of inherent risk including, but not limited to, the hazards of traveling in underdeveloped areas where road conditions and other facilities may be poor or lacking; the forces of nature; and accident or illness in remote regions without means of rapid evacuation.
Bookings are accepted on the specific condition that Ann Aveyard Photography acts only as an agent of the passenger in all matters relating to hotels, camps and all forms of transportation and other services which may be included in these tours. Ann Aveyard Photography may purchase these services from suppliers and other independent contractors, without warranties and representations from them and thus such services are not subject to its control.
The right is reserved to substitute hotels of comparable status and to make any changes in the itinerary where deemed necessary or caused as a result of adverse road or weather conditions, disruptions to airline schedules or any other valid reason.
While all precautions are taken to ensure the passenger’s safety and enjoyment on these tours, Ann Aveyard Photography shall not be liable for death, injury, delay, loss or damage arising from any cause and in any manner whatsoever or change of itinerary or act, including any acts of terrorism, acts of God and government, neglect, accident, error or omission caused by any of these suppliers or independent contractors, their employees, representatives or any event beyond the control of Ann Aveyard Photography. All baggage is carried at the passenger’s own risk. The airlines used to provide safari flights are subject to international air conventions limiting their liability.
It should be noted that the types of vehicles used for safaris on rough roads in East Africa are different from tour vehicles on the highways in developed countries and normally they do not have air-conditioning other than the standard ventilation fan. The Safari Landcruisers used throughout Africa for overland road safaris on the main highways beyond the parks are of a standardised design with sliding passenger windows. Open-sided safari viewing vehicles may be used inside the parks and conservancies. In most of the safari lodges where electricity is provided by a generator, these are turned off late at night until the following day. Water from taps in bathrooms is not suitable for drinking and filtered water is provided for drinking and cleaning teeth.
